Can I “stack” my medical payment “med pay” auto insurance coverage?

What are people talking about when they refer to “stacking” medical payment auto insurance  coverage?

The term “stacking” describes the insured’s ability to add policy coverage for medical payment coverage on multiple policies for the covered loss.  Thus, the insured may “stacks” the med pay coverage of his or her auto insurance policies to determine the total amount of med pay coverage available for the car or truck wreck.

In Alabama, whether an insured can stack the med pay coverage from multiple polices is determined by the rules of construction of the contract (insurance policy).  See United Services Auto Assoc. v. Smith, 329 So.2d 562 (1976).   In other words, if the insured’s auto insurance policy does not specifically exclude stacking, then the insurance company can be required to pay the maximum med pay coverage on each policy up to the limits of the insured’s medical expenses.  Ala. Farm Bur. Mut. Cas. Ins. Co., v. Pressley, 384 So.2d 122 (Ala. 1980).
